CREDIT APPLICATION

FOXWOODS CASINO CREDIT POLICY:

I hereby authorize the Mashantucket Pequot Tribe (“Tribe”), by and through the Mashantucket Pequot Gaming Enterprise d/b/a Foxwoods Resort Casino (“Foxwoods”), a wholly owned unincorporated instrumentality of the Tribe, to investigate my credit record and to furnish information concerning such credit record to credit reporting agencies and others who may properly receive this information.

I have reviewed all the information provided above and it is true and accurate. I authorize Foxwoods to conduct such investigations pertaining to the above information as it deems necessary for the approval of my credit limit. I am aware that this Application is required to be prepared by the Final Mashantucket Pequot Gaming Procedures, 56 Fed. Reg. 24996 (May 31, 1991), and that I may be subject to civil or criminal liability if any material information provided by me is willfully false. I hereby authorize Foxwoods, in its sole discretion, to apply Loss Discounts and any and all gaming cash equivalents I may redeem first to the reduction of any outstanding casino debt with the remainder, if any, to be returned to me.

I agree that any credit extended to me by Foxwoods will be governed by the laws of the Tribe, including the Final Mashantucket Gaming Procedures. By executing this Application, I consent to the jurisdiction of the Tribe, and any action with respect to such credit may be brought in the Mashantucket Pequot Tribal Court. Interest will accrue on the outstanding credit balance from the date any credit instrument is returned unpaid at a rate of twelve percent (12%) per annum. I agree to pay all costs of collection, including attorney’s fees. Any judgement may be enforced in any court of competent jurisdiction.

In any action brought in the Mashantucket Pequot Tribal Court under this Application, I agree that service of process shall be sufficient if such service is sent to me by registered or certified mail to the address noted above (or on this Application).
